The City of Victoria 55+ market is a small and specialized part of the local strata market. Most qualifying inventory is found in condominium and townhouse developments where the registered bylaws include an age restriction governing residency.

How 55+ Age Restrictions Work in BC

Under current British Columbia strata legislation, a strata corporation may adopt an age-restriction bylaw requiring one or more persons residing in a strata lot to have reached a specified age that is not less than 55 years.

The restriction is fundamentally about residency, not simply the age of the person whose name appears on title. The exact wording of the registered bylaw therefore matters when evaluating who may occupy the unit.

The legislation also provides exemptions in defined circumstances, including protections for certain existing residents and caregivers, together with prescribed classes of residents. Because household situations differ, buyers should verify the current statute, regulations and the strata's own registered bylaws for the specific property.

Marketing terms such as “adult building,” “retirement residence” or “senior-oriented” should not be treated as substitutes for reviewing the actual bylaws.

Age restriction does not determine pet policy. Review the current strata bylaws for permitted number, size, species and other restrictions.

A beautifully renovated unit can still be part of a strata facing expensive common-property work. Buyers should review council minutes, annual and special general meeting minutes, financial statements, contingency reserve funding, depreciation reports and insurance information.

Building-envelope work, windows, balconies, elevators, piping, roofing, parkades and mechanical systems can create substantial capital costs. Understanding what has already been completed and what remains planned is essential.

In a smaller 55+ building, a major project can affect each owner differently than in a large strata because the cost is divided among fewer units.

Buyers should also examine bylaws affecting pets, smoking, rentals, renovation work, flooring, parking, storage and use of common amenities. These can matter as much to daily enjoyment as the age restriction.

For townhouses, clarify which exterior components are common property and which are an owner's responsibility. Roofs, windows, decks, fences, landscaping and exterior doors can be treated differently from one strata to another.

If accessibility matters, physically test the route from parking to the suite, elevator dimensions, entrance thresholds, bathroom layouts and any stairs rather than relying on a general description such as “senior friendly.”

A smaller home can make the surrounding neighbourhood more important. Victoria offers a compact urban environment where many daily services, recreation opportunities and cultural amenities can be reached without long drives.
